Terms and conditions

Users who use the services offered by Nail Shop and Beauty declare that they know and accept these general contract conditions.

Products and purchasing procedure

All prices indicated on the site include VAT, unless otherwise stated, and may be subject to periodic changes without notice.
Each order sent constitutes an offer to purchase the products published on the site. Orders are subject to availability and discretionary acceptance of the Owner, who reserves the right to not confirm an order, in particular due to the possible unavailability of one or more of the products purchased. In this case the Owner will refund the price and shipping costs incurred by the User.
The actual availability of a product is indicative, as multiple users can purchase it at the same time and make a product unavailable that another user had already put in the cart.

Order processing times

Orders placed on the Nail Shop and Beauty e-shop are processed and processed within two working days of receipt.
The delivery times of the goods may vary depending on the product chosen, but never before 2 (two) working days.
The fulfillment and processing of orders may be delayed during the holidays.
Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays.

Deliveries

Deliveries are made to the address indicated by the customer at the time of purchase throughout Italy. The carrier assumes full responsibility for transport, from collection from the supplier to delivery to the indicated address.

In some critical periods for couriers, such as Christmas and other holidays, there may be delays in delivery. In this case Nail Shop and Beauty is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the products will be delivered within a maximum period of 20 (twenty) days starting from the day following that on which the Customer placed the order on the e-shop.

The delivery day will depend on the destination location and the availability of the ordered goods.
Deliveries are not made on holidays and days before holidays.

Nail Shop and Beauty is not responsible for any damage suffered by the user due to delays in delivery or any irregular behavior on the part of the carrier during the delivery phase.

Upon delivery, before accepting the package, the customer must verify:
– that the packaging is intact
– that the number of packages corresponds to what is indicated in the transport document and the contents before accepting it

Any damage to the product or packaging or the mismatch of the indications must be immediately reported to the courier by placing a WRITTEN CONTROL RESERVE on the proof of delivery. Once the courier document has been signed, the Customer will not be able to make any objections regarding the external characteristics of what was delivered.

In the event of failure to collect the material in stock at the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be cancelled.

Payments

The payment methods and rules applied are detailed on the pageSecure paymentsand the possibility to choose the payment method preferred by the customer occurs at the time of purchase.

For each order placed, Nail Shop and Beauty issues a sales document for the material shipped.
For issuing the invoice, the information provided by the customer at the time of the order is valid. The customer can request a copy of the invoice or tax receipt within three months of issue.

Delivery costs are borne by the customer and are indicated when placing the order except as clearly provided in the sales offer and in cases of minimum orders envisaged which gives the right to free shipping.

The goods are sent only after acceptance of the order and receipt of the credit. In the case of a bank transfer, the customer has 3 days to proceed with the payment of the order, under penalty of cancellation of the order itself.
In case of cancellation of the order, either by the Customer (for the reasons set out below) or in the case of non-acceptance of the same by the seller for reasons not attributable to his will, the cancellation of the same will be carried out and release of the committed amount (the release times depend exclusively on the banking system). Once the transaction has been cancelled, the seller cannot be held responsible for any damages resulting from the release of the committed amount by the banking system.

Right of withdrawal

Purchases on www.nailshopcesena.com are subject to the provisions of Legislative Decree 206 of 2005, which guarantees the right of withdrawal.
The exercise of this right is regulated as follows:
the returned products must be intact, preferably in the original packaging: for damaged or altered products it will not be possible to exercise the right of withdrawal.
This right is reserved for natural persons: resellers are therefore excluded.
You will have 14 days to change your mind about your purchase.
To exercise this right, you will need to:
send us an email within 14 days from the date of receipt of the goods, indicating:
– invoice number
- order number
- order's date
– the product or products for which you intend to exercise the right of withdrawal, indicating the item code
– your bank details (IBAN code), which we will use for the refund
We will send you a confirmation email and agree with you on the return methods, which must take place within 14 days of your communication, the date by which the refund will be made by us.
In general, although not expressly written, the legal provisions regarding distance contracts apply. Any possible dispute is subject to Italian jurisdiction.

Electronic invoice

By placing an order on the website www.nailshopcesena.com, you give your consent to receive the invoice only in electronic format. The invoice must be printed and archived as the original in accordance with Ministerial Circular 45/E, 19/10/2005.

Applicable law and competent court

These terms and all disputes regarding the execution, interpretation and validity of this contract are subject to Italian law. The parties undertake to submit any dispute, within the limits of applicable legislation, to the jurisdiction of the Italian courts, with exclusive jurisdiction identified in the Court of Forlì-Cesena.
